Terms

“We”, “our” and “business”, when used below, refer to Barry’s Guided Tours.

“Customer” and “you”, when used below, refer to the party who has made the payment (whether full or deposit) for a tour or other event and others who accompany them under the same booking.

All bookings with Barry’s Guided Tours are subject to the following terms and conditions. Your statutory rights are not affected.

 Bookings

“One-day” means where walkers gather for an event and depart the completed event on the same day.

“Weekend” means an event where people gather on day 1 and depart on day 2, 3, or 4, depending on the duration of the particular event.

“Longer tours” typically means an event where people gather on day 1 and depart on day 7 or 8, depending on the duration of the particular event.

In the case of one-day and weekend events, a booking is deemed to have been made when Barry’s Guided Tours has received the full fee due.

In the case of longer tours, a provisional booking is deemed to have been made when Barry’s Guided Tours has received the appropriate booking deposit. Note, however, that such a booking is subject to the full payment of all outstanding balances by the date outlined in the particular tour’s description on this site and/or in email communication forwarded by Barry’s Guided Tours upon receipt of said deposit.

Payment

Payment may be made by bank transfer, cheque, or credit/debit card via this website. Please note that no payment is accepted on the day of any event and all bookings must have been completed prior to the start of any event.

All events are priced in Euro and where a customer pays from an account in another currency, it is their responsibility to ensure the correct Euro amount reaches the bank account of Barry’s Guided Tours.

Full payment for one-day and weekend events is due at the time of booking.

For longer tours, a booking deposit may be required to secure your booking. The balance in full is then due 8 weeks before the start of events that are longer than 3 days in duration. Confirmation of such bookings cannot be guaranteed if full payment has not been received by 8 weeks prior to the tour start date.

If the full balance of the fee has not been received by 8 weeks prior to an event, then the business reserves the right to cancel the booking. In this case, the deposit paid is forfeited by the customer.

In the event of a booking for longer tours being made less than 8 weeks before the start date, the total fee is then payable at the time of booking.

Modification or Cancellation of a Tour by the Business

While we always aim to operate all our tours as advertised, we reserve the right to modify or cancel any tour before its start date.

In the event that we have to cancel a tour, the customer shall receive a full refund of the monies paid to us, but will not be entitled to any further sum by way of compensation, damages or otherwise, arising from said cancellation. This applies no matter when the tour is cancelled.

Our tours are dependent upon a minimum number of customers. Where the minimum number of customers has not been met prior to the start date, we are entitled to cancel the event. In such circumstance, all monies paid to Barry’s Guided Tours shall be refunded to the customer.

However, the business is not responsible for any additional expenses that may have been incurred by the customer in preparing the trip. Examples might include where you have booked accommodation for the night prior to or following the cancelled event. Please note especially regarding overseas trips, where the customer pays for his/her flights directly with an airline, that his/her contract for transport to the overseas destination is with the airline or travel agent and not with Barry’s Guided Tours.

Force Majeure

Where war or terrorist activities, threatened or actual, civil unrest, virus or other disease, industrial action, threatened or actual, weather conditions, fire, flood, drought, airport regulations or closures, unforeseen alterations to public transport schedules and rescheduling of aircraft, government advice, instruction, moratorium or regulation on travel, or any other event outside the control of Barry’s Guided Tours either delays or extends the tour or compels a change in prior arrangements, the business cannot accept liability for any resulting loss, damage or expense to the customer.

Modification or Cancellation of a Booking by the Customer

Where the customer wishes to modify their booking for a tour, Barry’s Guided Tours will do its utmost to assist and facilitate, at no charge. If there are circumstances where the business needs to charge a fee, this will be communicated to the customer.

Where the customer cancels their booking and the business had already accepted said booking, the following charges shall apply.

One-day and Weekend Events

  • A cancellation fee of 100% applies for cancellations made 7 days or less in advance of the event start time, or in case of no-show.
  • No cancellation fee applies for cancellations made more than 7 days in advance of the event start time, other than what is refered to in the paragraph below.

Please note that trips to the Iniskeas and other offshore islands are an exception to the above conditions.

Cancellations of these offshore island bookings are not permitted. Once these trips have been paid for, there is no refund, although you are welcome to change the name of the guest(s) at no extra fee. Only when it is the business which cancels these trips is a full refund paid to customers.

Longer Events

The booking of longer events incurs the initial payment of a deposit, typically €200 per person. This deposit is forfeited if a booking is cancelled at 16 or more weeks ahead of the event start date.

Other than the deposit, therefore, the following applies :

  • A cancellation fee of 100% applies for cancellations made 8 weeks or less in advance of the event start date, or in case of no-show.
  • No cancellation fee applies for cancellations made more than 8 weeks in advance of the event start time, other than what is referred to in the paragraph above about deposits and in the paragraph below about service fees.

Payment Service Fees Deduction

Please note that all refunds will have payment service fees that had been charged to Barry’s Guided Tours deducted. This amounts to approximately 3% of the fee the customer had paid. For example, a booking of €60 will typically be refunded approximately €58.20.

Insurance & Barry’s Guided Tours’ Liability to the Customer

Although we take the greatest care to ensure that everything runs smoothly during our events, accidents can happen.

It is essential that you are adequately insured to cover medical expenses, loss or damage to/of personal property, injury, death, repatriation, cancellation and curtailment.

For this reason, you should take out adequate insurance cover prior to travel. Please note that Barry’s Guided Tours cannot accept any liability relating to personal injury or illness, loss or damage to personal equipment, or any other unforeseen events that occur during your tour.

Note that Irish and other EU citizens travelling within the EU are entitled to a European Health Insurance Card (EHIC), which simplifies the procedure when receiving medical assistance during their stay in a member State.

The EHIC (commonly referred to by its old name, the E111) entitles the holder to the same treatment at the same cost as a national of the country where medical assitance is required. Presentation of the EHIC guarantees reimbursement of the medical costs. In the event of treatment being required, the card should be presented at the earliest opportunity. In other words, please carry it on your person at all times. Not 100% of the costs are reimbursed, but your insurance should make up the deficit.

Therefore, it is essential that each guest takes out a travel insurance policy for the entire duration of the trip.

Any information or advice provided by the business on matters such as walking routes, climate, clothing, travel documents, baggage, special equipment, etc., is given in good faith, but without responsibility on the part of the business.

The customer accepts full responsibility for obtaining any necessary visas and travel documents needed to allow them to take a tour with Barry’s Guided Tours.

Barry’s Guided Tours is not liable for any activity which is provided by or availed of through a third party while customers are on any of our tours, e.g. horse riding, cycling, kayaking, boat trips, etc. Nor is the business liable if a customer decides to engage in any activity of their own volition, e.g. swimming, etc.

Health, Fitness & Due Care

Walking (aka hiking) is a physically strenuous outdoor activity, usually undertaken in remote locations, and thus has an element of risk associated with it.

The customer who books to join an event with the business understands and accepts that there is risk involved. The customer must be confident that they have a level of personal health and fitness sufficient to engage in such activity. Furthermore, the customer confirms that they do not suffer (and have never suffered) from any pre-existing medical condition which would preclude them from participating in such an activity.

All customers must inform the guide, prior to the commencement of any event, if they have any underlying health issues, e.g. suffer from asthma, allergies, etc.

The customer will observe due care at all times and be mindful of their personal safety and that of other members of a group and of the group as a whole. Furthermore, the customer agrees to heed the advice and instructions of the guide in relation to matters of safety, direction, etc, at all times.

The decision of the guide (Barry Murphy) is final in all matters of route choice, shortcuts to be taken or not, cancellations, modifications, etc, to any tour or event.

Customers are strongly advised to have their own personal health insurance cover.

Jurisdiction

This contract is made on the terms of these booking conditions which are governed by Irish Law and customers shall submit to the jurisdiction of the Irish Courts.

Tour information & Feedback

Our website contains general descriptions of the various tours available, outlining the itinerary and services included in the price. Changes in any or all of these items may need to be made from time to time and the business reserves the right to do so without consulting customers who have booked.

For longer tours, a PDF brochure will be emailed to all customers, with further details, additional to what appears on this website.

Our website contains statements representing the honest belief of the business that the facts as shown are correct.

Every reasonable effort has been made to fully describe the tours offered and every reasonable attempt will be made to honour what has been described.

Notwithstanding the above, Barry’s Guided Tours reserves the right to make changes to the information, prices and itineraries set out in the website and such changes shall be binding on the parties.

Likeness / Imagery

Any likeness or images of you secured or taken on any of our tours or any imagery/media which you capture and share with us (e.g. either by email or on social media), may be used by Barry’s Guided Tours, without charge in all media, for bona fide promotional or marketing purposes, including without limitation promotional materials of any kind, such as brochures or on the Internet.

In the interests of continuing to offer the best possible standards of service, Barry’s Guided Tours reserves the right to share, or not to share, any feedback or comments received from you with our business partners, be they accommodation suppliers, luggage transfer providers, taxi drivers, etc. The business commits to only doing this, where your feedback can be useful to our partners to better or improve their service.

Luggage Transfer Service

Each customer of Barry’s Guided Tours is entitled to one item of baggage to be transferred along the route during their longer tour.

This does not apply to one-day, weekend and other short events.

An upper weight limit of 17kg per person applies to the luggage transfer service included in all our longer tour packages. The business and its transfer partners reserve the right to refuse the transfer of loads which exceed either of these limits (number of items and/or weight).

Luggage will not be transferred from or to locations which are outside the tour itinerary you have booked. If you have booked an extra night’s accommodation in a location outside the tour itinerary, your baggage will not be transferred to or from this location.

Neither Barry’s Guided Tours nor its partners (taxi drivers, minibus transfer businesses, accommodation providers, etc.) can accept any liability relating to loss or damage of personal property during the transfer of luggage during your tour. For this reason, valuable or breakable items (e.g. jewellery, electronic devices, cash, cameras, etc.) should not be le in baggage due to be transferred.

Barry’s Guided Tours strongly encourages you to take out adequate insurance cover, prior to travel, for loss or damage to personal property.
